The absence of planning conditions could allow the site to operate 24/7 by default

Planning documents have revealed that MFG is seeking permission to run a forecourt in South Ayrshire 24 hours a day.

The Morrisons site in Troon, a port town on the west cost of Scotland, currently operates from 6am to 10pm, but MFG says it believes is entitled to keep the site open on a 24/7 basis due to a lack of opening-hour restrictions in its extant planning permission.

The firm has applied to South Ayrshire Council for a Certificate of Lawfulness confirming this, arguing: “It appears from the local planning authority public records that there have been no planning applications granted with conditions that restrict opening hours of the petrol filling station.”

The proposals go on to say that in the absence of such restrictions, MFG is seeking a Certificate of Lawful Development “certifying that proposed 24 hour opening is lawful”.
